1. Introduction
Bagual ("we", "us", "our") provides an AI‑powered platform that helps publishers create images and videos (the "Services"). By using the Services you agree to these Terms of Service ("Terms").
2. Eligibility & Accounts
• You must be at least 18 years old.
• You are responsible for safeguarding your account login.
• If you connect an Instagram account you must have permission to do so.
3. Plans, Credits & Renewal
Our Service is offered under various subscription plans, which are detailed on the plans section on our homepage. Each plan includes a specific number of credits for use within the Service. Unused credits expire at the end of each billing cycle. Subscriptions renew automatically until you cancel from your account page.
4. Service Description
• Create "photo studios" and "reel studios".
• Generating images and videos consumes credits. The specific credit cost for each action is available on our plans page.
• Bagual is not endorsed by or affiliated with Meta Platforms, Inc. or Instagram.
5. Payments & Billing
Payment processing will be available soon. We will update these terms when payment functionality is implemented.
6. Your Content & AI Outputs
You own the images, videos, and other content ("Creator Content") you upload or generate. You grant us a limited licence to store and process Creator Content solely to provide the Services. We may use aggregated, anonymised data to improve our models.
7. Acceptable Use
Do not:
• Break any law or Instagram rule.
• Upload or request illegal, harmful, or infringing content.
• Interfere with or reverse‑engineer the Service.
We may suspend or terminate accounts that violate these rules.
8. Intellectual Property
The software, templates, and Bagual brand remain our property. You may not copy, sell, or exploit them without permission.
9. Disclaimer & Limitation of Liability
The Service is provided "as is" without warranties. Our total liability is limited to the greater of US $100 or the amount you paid us in the 12 months before the claim.
10. Termination
You may stop using the Service at any time. We may suspend or close your account with notice if you breach these Terms. We will delete or anonymise your Creator Content within 60 days, unless we must keep it for legal reasons.
11. Changes to Terms
We can update these Terms at any time. We will post the revised version and, for material changes, give 14 days’ notice. Continued use after the effective date means you accept the changes.
12. Governing Law
These Terms are governed by the laws of Brazil. Disputes will be resolved in the courts of Pelotas, Rio Grande do Sul.
